Who are the victims in a road traffic accident /RTA/?

•  All persons, who have been caused a light, medium or severe bodily injury as a result of an occurred RTA.
•  Relatives of a person, killed in a road accident

What types of insurance can guarantee you are paid benefits by an Insurer?

•  "Third-party liability" of motorists
•  "Accident" of passengers in public transport

Who is entitled to compensation?

•  If you are a passenger, injured in an accident...
•  If you are a pedestrian, injured in an accident...
•  If you are a driver of a vehicle, injured in an accident...
•  If a relative of yours has died in a road accident...
The person, who has been injured or whose property was damaged or whose close relative has died in a road accident, is entitled to claim compensation from the Insurer, with whom the guilty driver has concluded obligatory "Third - party liability insurance" /TPL/. The guilty driver is not entitled to compensation under TPL insurance.

When the guilty driver hasn’t got a valid "third-party liability" or "accident” insurance or when the guilty driver is not known, the injured person is entitled to claim compensation from a Guarantee fund.

When the guilty person is a foreign citizen with "third-party liability” insurance concluded with a foreign Insurer or the RTA has occurred on the territory of another country and the injured person is a Bulgarian citizen, he is entitled to claim compensation in Republic of Bulgaria from a National bureau of Bulgarian motor insurers.

The benefit, which the injured person will receive, is AN AMOUNT OF MONEY.
What are the damages, covered by "Third-party liability” insurance

•  Property damage, incurred on another car or another person’s property; the costs for treatment, medicines, rehabilitation of the injured person; funeral services and goods for the person killed in the accident;
•  Non-material damage, incurred as a result of bodily injury to the injured person or to the relatives of the person killed in the accident - the pain and suffering endured.
•  Benefits forgone, which are a direct and immediate result of the RTA
•  Costs, associated with filing a claim in front of the Insurer, including judicial costs, solicitor fees, etc.
The limitation period, within which you have the right to claim a compensation in front of an Insurer, is:

•  5 years under "third-party liability” insurance
•  3 years under "accident” insurance
* the period starts running from the date of occurrence of RTA

What will happen when a medium and/or serious bodily injury is caused in a RTA or death has occurred?
First phase Criminal proceedings /CP/
CP are lead by an investigating police officer in the structure of the Ministry of the Interior under the supervision of an overseeing prosecutor from the competent prosecutor's office for a period of 2 months. The period may be extended by the prosecutor up to two times with two months or the period for completion of the work on criminal proceedings may be up to 6 months long in total. Facts and circumstances concerning the road accident having occurred are clarified in its course. Reports, drawings, expert analyses (among which the legal-medical analysis /LMA/ and auto-technical analysis /АТA/ are the most important) are prepared, witnesses are questioned. After clarifying the factual situation, the investigating policeman completes his work on the criminal proceedings and sends the materials to the overseeing prosecutor. The powers of the prosecutor include:


•  Ruling with a Ruling of termination
•  Submitting the indictment in the court
•  Preparing a proposal for exemption from criminal liability by imposing an administrative penalty or a proposal for resolution of the case by an agreement
•  If the perpetrator is unknown, the prosecutor pronounces a decision by a Ruling for termination and sends the case to the authorities of the Ministry of the Interior to carry out actions related to searching for the perpetrator

Second phase Legal proceedings - the case is submitted to the court by the prosecutor, together with the indictment, and is heard in three instances.

Third phase Filing a claim for benefits in front of an Insurer /Guarantee fund or National bureau of Bulgarian car insurers/ - the term for pronouncing a decision is 15 days, but not more than 3 months.
